PAYMENT secures your participation in the event but does not GURANTEED placement until both payment AND application is received. Payments are due within 3 business days of acceptance. Returned payments are subject to a $35 fee plus any collection costs. Applying does not constitute a reservation and acceptance does not constitute automatic acceptance into future shows. Vendors application is for consideration only and is not guaranteed of Vendors placement or entry into the show. Vendor’s entry fee is nonrefundable unless not admitted to the show. Approved cancellations may receive credit or partial credit, upon approved credit there is a $20 re-booking fee for future shows. Date changes are subject to approval and must be submitted no later than 60 days prior to the date you are booked for and require a $20 change fee. Cancellations and date changes may be subject to re-payment of discounted fees. No show/No calls will NOT receive a refund or any credit for future shows. You must notify us at least 60 days prior to the show you are using credit for (subject to availability and approval). Cancelling on a Show using a credit will forfeit that credit. Vendor will display only product that is of high quality and approved by Company. Company reserves the right of refusal to display or sell any product that was not previously approved or is deemed inappropriate. Any product or items left behind after the show will be donated to charity. Shared spaces are allowed, only if the vendor you are sharing your space with has applied AND has been approved. Failure to disclose the sharing of your space may result in (including but not limited to) immediate removal from the show that day, suspensions, fines, zero refund and/or no future credit.

 

Company shall have no liability for any lost, stolen, or damaged merchandise. All sales generated by Vendors are the sole responsibility of the vendor. Company is not responsible for any sales or transactions on behalf of its Vendors. Vendors agree to collect their own money and be responsible for their own individual income and sales taxes. Vendors agree to have and keep current any local and state permits required for selling their products. Vendors relationship with Company is that of an independent contractor and vendor here by releases company from all liability or responsibility that would occur if vendor was an employee. Because vendor is an independent contractor and not an employee! Vendors are to maintain their own Worker’s Compensation insurance at Vendors expense. Company is not responsible for any liability including injury or death that may be caused by Vendor’s products and or displays. Vendor releases company from any liability which may result from illness injury or death due to the consumption of any food products. Vendors are responsible for carrying their own individual liability insurance and agreed to hold company harmless to any claims. Vendor agrees to abide by all facility policies and is responsible for any damages to the facility or their equipment.

 

Vendor spaces are assigned by the show/market manager and are subject to change at any time. Vendors are NOT guaranteed to a specific space.Vendors will stay within the boundaries of the space paid for, spaces may be moved or rearranged by company at any time. All the Vendors table coverings and product displays are to look their ABSOLUTE best. Vendors are responsible for keeping their spaces staffed throughout the show. Company does not guarantee a certain number of sales and/or customers. All canopies and/or umbrellas must be weighted. Vendor is responsible for all damages because of unweighted canopies and umbrellas.

 

VENDOR hereby grants COMPANY the irrevocable right and permission to use photographs and/or video recordings of vendor on websites and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation. By submitting an application, you are agreeing to be added to our mailing list that includes frequent email and text communications. You can opt-out anytime by clicking the unsubscribe link at the bottom of our emails or replying STOP to our text messages.

 

In the event of a show cancellation (due to an act of God), a new date will be determined by Company. All applications from the cancelled event will carry over to the new show date. This is a rain or shine Show except for severe weather. It is the Show MANAGER’S discretion to cancel due to weather. All applications from the cancelled show will automatically carry over to a new show date.

 

Loading and unloading merchandise, Vendors will be provided with temporary parking and is available by request. All Vendors must park their vehicles in the specified areas no later than the start of any show. Vendors are not to park in customer areas, any violators may be towed. Never leave your vehicle unattended while loading and unloading. Set up begins two (2) hours prior to the Show. You CAN NOT begin setting up until you have checked-in with the Show manager/s. Vendors are required to be setup and ready no-later then 15 minutes prior to Show opening. Vendors are required to stay for the ENTIRE SHOW!! – NO EXCEPTIONS!! Anyone breaking down early will be subject to a $50 fine and possible suspension from future shows.

 

Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; 2. I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties; and 3. I hereby knowingly assume the risk of injury, harm and loss associated with the Activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.

 

In signing, vendor states they have read and agree to abide by the above-mentioned terms and conditions and acknowledge that they pertain to all shows promoted by Company. this agreement shall be construed in accordance with the governing laws of the state of California, county of orange.
